Using Litarium
These terms are between you and Litarium LLC, a New York limited liability company. They cover our website, mobile applications, and related services, including test versions. By using these services, you agree to these terms. You must be at least 18, or older if local law requires it. For the iOS app, Apple's Standard End User License Agreement also applies; these terms supplement it.
Your account
Give us accurate information, keep your sign-in details secure, and tell us if you think someone else has accessed your account. You are responsible for activity under your account unless the law says otherwise.
Features coming soon
Litarium is in development. Planned features include library tools, recommendations and matching, reading insights, and challenges. Descriptions and previews are not a commitment to a particular release date or feature set. Features may vary by version, subscription plan, or location.
We plan to launch worldwide, including the US, where local requirements and app-store availability allow. Book information, recommendations, matches, and insights can be incomplete or inaccurate. They are not professional advice.
Service changes
We may update, replace, or discontinue features, including for maintenance, security, or legal reasons. Where a change materially affects a paid service, we will provide the notice and remedies required by applicable law. Planned features do not guarantee future availability.
Using our website and software
You may access and use Litarium for personal, lawful purposes under these terms. Our software, designs, and branding belong to Litarium or its licensors. Book covers, book information, and other third-party materials remain subject to their owners’ rights. These terms do not transfer ownership or grant rights beyond using the service, except as applicable law permits.
Third-party services
Litarium may link to or use services provided by other companies, such as app stores, sign-in services, and book-data sources. Their own terms may apply to your use of those services. A link does not imply endorsement, and we do not control independent websites.
Our Privacy Policy explains how providers handle information as part of Litarium. This section does not remove our responsibilities for information handled on our behalf or your mandatory consumer rights.
Subscriptions
If paid features are offered, the price and billing period will be shown before purchase. Subscriptions renew automatically unless canceled through the App Store or Google Play. Store rules govern billing, cancellation, and refunds, subject to your mandatory consumer rights. Deleting your Litarium account does not cancel a store subscription.
Your content
You keep ownership of the notes, reviews, and other content you add. You give Litarium a limited license to store, process, and display that content only as needed to provide the service to you. You can end that license by deleting the content or your account, subject to lawful retention. You must have the rights needed to submit the content you add.
If an available feature lets you share content, the license also allows us to display it to the audience you choose. It does not give us ownership or permission to use your private content for unrelated purposes.
Acceptable use
Do not use Litarium to:
- break the law or violate another person's rights;
- harass, threaten, impersonate, or exploit anyone;
- share hateful, discriminatory, sexually explicit, or deceptive content;
- upload malware or interfere with the service;
- scrape, reverse engineer, or bypass access and usage limits, except where applicable law permits it; or
- post content you do not have the right to share.
We may remove content or limit an account when reasonably needed to protect people, the service, or legal rights. Reporting and blocking tools may also be available in the app.
Copyright
To report content that you believe infringes your copyright, email support@thelitarium.com. Identify the copyrighted work and where the material appears. Include your contact details, physical or electronic signature, a good-faith statement that the use is unauthorized, and a statement under penalty of perjury that the notice is accurate and you are the rights holder or their authorized representative.
We remove or disable access to material identified in valid notices and terminate repeat infringers' accounts where appropriate. If you believe a removal was mistaken, contact us for the counter-notice process.
Ending access
You may stop using Litarium at any time and may request account deletion. We may suspend or end access for serious or repeated violations of these terms, legal requirements, or security risks. Where practical, we will explain the reason.
Disclaimers and liability
Litarium is provided “as is” and “as available” to the extent allowed by law. We do not promise uninterrupted service or that every book record, insight, or recommendation will be accurate. To the extent allowed by law, our liability for a claim arising from your use of Litarium is limited to the amount you paid us in the 12 months before the claim. Nothing here limits rights or remedies that cannot legally be limited.
Governing law
New York law governs these terms. This does not limit the mandatory consumer protections that apply where you live or any right you have to bring a claim in your local courts.
General terms
If a provision cannot be enforced, the remaining provisions continue to apply to the extent permitted by law. A delay in enforcing a provision does not waive the right to enforce it later.
Changes and contact
We will update the date above when these terms change and provide notice of material changes before they take effect, except where an immediate change is required for legal or security reasons. We will seek your agreement where required by law. Questions can be sent to support@thelitarium.com.
